Terms and Conditions for Flight Offerings
- Waiver / Registration. Each time the Buyer arrives at the facility they must complete and update a new waiver. Flying may be subject to safety protocols in place at the time that include but are not limited to no hard casts, weight restrictions, no previous shoulder dislocations etc. Buyer agrees that their flight offering is subject to following all safety protocols.
- Birth Date / Identification. Upon arrival Buyer may be asked to provide proof of birth date and other reasonable forms of identification. Buyer agrees to provide proof of identity if requested. Buyer may need to provide proof of right to execute a waiver on behalf of a minor. Buyer agrees to provide proof of right to execute if requested.
- Ask your Mama! If Buyer is not 18 years old, Buyer should obtain parents’ or guardians’ permission. Buyer is advised to obtain parents’ or guardians’ permission even when over 18 years old. Buyer’s parent or guardian may be required to sign waiver / registration on behalf of a minor.
- Date of Flight. Under reasonable circumstances every effort will be made to accommodate flying on the date of Buyer’s choice. Whether impacted by scheduled maintenance, unscheduled maintenance, weather, transportation, holidays, full stadium event days, or other extenuating circumstances, the Buyer acknowledges that date may be subject to change at the sole discretion of the Seller. Buyer acknowledges they may not always get to schedule flying on the exact day of their choice.
- Scheduled Flight Time. All flight offerings will occur during normal business hours. Buyer acknowledges that it is their sole responsibility to schedule their Flight(s) with Freedom Wind via booking online or calling the Seller’s sales desk. The Buyer acknowledges that choices of specific times and days may be limited. The Seller agrees to offer multiple appointment choices to the Buyer that vary by time of day and day. In all cases Seller will make reasonable effort to accommodate as close to the Buyer’s date choice as the circumstances allow.
- Flying experience. Each flying experience will be the “Basic” retail customer experience available at the time. Buyer acknowledges that flying is subject to prompt arrival on day of the flight. If the Buyer arrives later than 20 minutes prior to scheduled reservation it may be canceled or rescheduled with a possible fee at the sole discretion of the Seller. The Seller cannot be held responsible for any missed reservations.
- Date Non-Exclusivity. Buyer acknowledges that their appointment and their flying session may be on the same day and during the same session as other Buyers.
- Photography and Video. Buyer consents to having their photo and pictures taken and that the Seller then owns and may use such materials in any advertising, promotions, or any other manner without needing permission from or consideration to the Buyer.
- Successors or Assigns & Transfers of Ownership. This offer is being made by Freedom Wind Tunnel LLC (“Seller”). In any circumstance where transfer of control of the ownership or controlling interest in the tunnel operation changes, the offer may or may not be continued. Continuation of the flight offers is at the sole discretion of the subsequent owners.
- Transfer of Flight Offering. The Seller will provide a digital certificate. If Buyer later decides to transfer the flight offering to another person, the Buyer will elect to do so prior to booking.
